Having considered all the evidence before me I have concluded that the Authority is entitled to adopt the position that it has and that its decision not to take enforcement action does not amount to maladministration

Recommendations

I do recommend that, not withstanding the conclusions I have reached there still remains the need for there to be regular meetings between the Authority and the Trust and the Environment Agency to ensure that if any future work is contemplated then it is done so in an open and transparent manner.

Such meetings should be properly minuted and any proposals fully recorded as to the likely impact on the relevant activities of the above organisations

We cannot appeal to the Government Ombudsman as "We do not have a financial interest"
